2. These Terms
These Terms govern your use of our website and purchases made through Zima Store.
By accessing our website or placing an order, you agree to these Terms. Please read them before completing a purchase.
Our following policies also form part of these Terms:
- Return and Refund Policy;
- Shipping Policy;
- Privacy Policy;
- Cookie Policy or cookie preferences;
- Any specific terms displayed on a product page or promotion.
If there is a conflict between these Terms and a specific product or promotion term, the more specific term will apply to that product or promotion, provided it is lawful and fair.
Nothing in these Terms limits your statutory consumer rights.
3. Eligibility to use the store
You must provide accurate information when placing an order.
If you are under 18, you should use our store and place orders only with the involvement and permission of a parent or guardian.
You must not use our website or products for any unlawful or fraudulent purpose.
4. Products
We sell clothing and other products featuring Zima Store branding, illustrations, comedy and internet-culture-inspired artwork.
Many of our products are manufactured only after an order is placed. We use third-party print-on-demand manufacturers and fulfilment providers, including Printify and print providers available through the Printify network.
The fact that a standard catalogue product is manufactured after ordering does not, by itself, mean that the product is legally personalised.
We aim to describe and display our products accurately. However:
- Colours may appear slightly different depending on your screen, device and display settings;
- Placement and dimensions of printed or embroidered designs may vary slightly between sizes;
- Minor differences may occur as part of the production process;
- Product measurements may have reasonable manufacturing tolerances.
These reasonable variations do not affect your rights where a product is faulty, materially different from its description or otherwise does not meet legal requirements.
Please consult the relevant product description and size guide before ordering.
5. Product availability
All products are subject to availability.
Because we use third-party manufacturers, a particular product, colour, size or print provider may occasionally become unavailable after you place an order.
If we cannot supply an item, we may:
- Contact you to offer a suitable alternative;
- Ask whether you are willing to wait;
- Cancel the affected item and issue a refund.
We will not substitute a materially different product without your agreement.
6. Prices
Prices are displayed in pounds sterling unless otherwise stated.
Prices include any taxes that we are legally required to include. Delivery charges are shown separately during checkout before you place your order.
We may change our prices at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing error that a reasonable customer would recognise as a mistake.
If we identify a pricing error before accepting your order, we will contact you and give you the choice to proceed at the correct price or cancel the order.
7. Delivery charges and international costs
Delivery charges depend on factors such as:
- The product ordered;
- Delivery destination;
- Number of items;
- Print provider;
- Delivery method.
The applicable delivery charge will be displayed during checkout.
Where international delivery is offered, the customer may be responsible for local import duties, customs charges or taxes that are not collected by us at checkout. Any such charges are imposed by the destination country and are outside our control.
8. Placing an order
Before submitting an order, you will have an opportunity to review and correct your:
- Products;
- Sizes and colours;
- Quantities;
- Delivery address;
- Billing information;
- Delivery method;
- Total price.
Please check this information carefully.
Selecting the checkout button that confirms payment means that you are placing an order with an obligation to pay.
After placing an order, you should receive an order-confirmation email. A binding contract between you and Zima Store is formed when we send your order confirmation, subject to our right to cancel and refund an order where:
- The product is unavailable;
- Payment is not authorised;
- The order appears fraudulent;
- There is an obvious pricing or product-information error;
- We cannot lawfully supply the order;
- The order breaches these Terms.
If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method.
9. Payment
Payment must be made using one of the payment methods offered during checkout.
Payments may be processed by Shopify Payments, PayPal or another payment provider shown at checkout. These providers may perform payment-authorisation, security, fraud-prevention and identity checks.
We do not normally receive or store your complete payment-card number or card security code.
You confirm that:
- You are authorised to use the selected payment method;
- The payment information you provide is accurate;
- Sufficient funds or credit are available.
We may delay or cancel an order where payment is declined or where fraud or security concerns arise.
10. Print-on-demand fulfilment
Products may be manufactured and dispatched by Printify or a third-party print provider acting on our behalf.
Although another company may manufacture or dispatch your product, your purchase contract remains with Zima Store. Questions, complaints, cancellations and return requests should be sent to us rather than directly to Printify or the print provider.
Different products in the same order may:
- Be produced by different providers;
- Be dispatched from different locations;
- Arrive in separate parcels;
- Have different tracking numbers or delivery dates.
You will not be charged additional delivery fees after checkout merely because an order is divided into separate parcels, unless you have expressly agreed otherwise.
11. Production and delivery estimates
Estimated production and delivery times may be displayed on product pages, during checkout or in your order confirmation.
These are estimates rather than guaranteed delivery dates unless we expressly agree a specific guaranteed date.
We aim to deliver orders within the stated timeframe and, unless a different period has been agreed with you, no later than 30 days after the contract is formed.
Delivery may be affected by:
- Production delays;
- Product availability;
- Courier delays;
- Customs processes;
- Severe weather;
- Strikes;
- Peak seasonal demand;
- Incorrect or incomplete delivery information;
- Events beyond our reasonable control.
If a material delay occurs, contact us at zimastoreadmin@gmail.com. Your legal rights regarding delayed or failed delivery remain unaffected.
12. Delivery information
You are responsible for providing a complete and accurate delivery address.
Please contact us immediately if you notice an error. We will attempt to correct it, but changes may not be possible once production or dispatch has begun.
We are not responsible for delays or failed delivery caused by inaccurate information supplied by you. Additional production or delivery charges may apply if an order has to be produced or shipped again because the original address was incorrect or incomplete.
This does not apply where the delivery problem was caused by us, the manufacturer or the delivery provider.
13. Risk and ownership
The risk of loss or damage passes to you when the product is delivered to you or to a person identified by you to receive it.
Ownership of the product passes to you once we have received full payment and the product has been delivered.
14. Cancelling an order
For standard, non-personalised products, you may normally cancel your order from the time it is placed until 14 days after delivery without giving a reason.
To cancel, contact us clearly stating that you wish to cancel. You may use the cancellation form at the end of these Terms, but you are not required to use that exact form.
If you contact us before production starts, we will attempt to stop the order and issue a refund.
Because products may enter production shortly after ordering, we cannot guarantee that production or dispatch can be stopped. If the product has already been dispatched, you may need to receive it and return it in accordance with our Return and Refund Policy.
After notifying us of cancellation, you must normally return the item within a further 14 days.
Additional details, including return-postage responsibility and refund timing, are set out in our Return and Refund Policy.
Your statutory rights are not removed merely because production has already started for a standard catalogue product.
15. Personalised products
A product is treated as personalised where it is genuinely manufactured using specifications or content supplied specifically by you, such as:
- Your name;
- Your photograph;
- Custom text;
- Individually requested artwork;
- Another customer-specific design.
Genuinely personalised products cannot normally be cancelled or returned merely because you have changed your mind.
This exception does not apply where a personalised product is:
- Faulty;
- Damaged;
- Incorrect;
- Not as described;
- Not produced according to the agreed specifications.
A standard Zima Store design offered identically to all customers is not treated as personalised simply because it is printed after the order is placed.
16. Returns and refunds
Returns and refunds are governed by our Return and Refund Policy.
For an ordinary change-of-mind return:
- You must notify us within 14 days of delivery;
- You must return the item within a further 14 days;
- You are normally responsible for arranging and paying return postage;
- Items should not be used or handled beyond what is reasonably necessary to inspect them.
Where an entire qualifying order is cancelled, we will refund the price paid and the cost of our least expensive standard outbound delivery option.
We may reduce a refund where the value of a product has been reduced by handling beyond what would reasonably be permitted when examining it in a physical shop.
We do not charge a restocking fee.
17. Faulty, damaged or incorrect products
Products must be:
- Of satisfactory quality;
- Fit for their normal or stated purpose;
- As described;
- Consistent with any sample or model where applicable.
Contact us as soon as reasonably possible if a product arrives faulty, damaged, incorrect or materially different from its description.
We may request:
- Your order number;
- A description of the issue;
- Clear photographs of the product;
- Photographs of the packaging and shipping label.
Depending on the circumstances and your statutory rights, we may offer:
- A replacement;
- A repair where appropriate;
- A full or partial refund;
- Another suitable remedy agreed with you.
Where we require a faulty or incorrect product to be returned, we will cover reasonable return costs.
Nothing in these Terms excludes or restricts your rights under the Consumer Rights Act 2015.
18. Exchanges
We do not currently guarantee a direct exchange service for change-of-mind returns.
Where you ordered the wrong size or colour, you may return the original item in accordance with our Return and Refund Policy and place a new order.
Where we supplied the wrong or faulty item, we may arrange a replacement directly.
19. Promotions and discount codes
Promotional offers and discount codes may be subject to additional conditions displayed when the promotion is announced.
Unless otherwise stated:
- Promotions cannot be exchanged for cash;
- Discount codes cannot be applied retrospectively;
- Only one discount code may be used per order;
- A promotion may have an expiry date;
- Some products may be excluded;
- Discount codes must not be obtained or used fraudulently.
We will not withdraw a promotion from an order after it has been validly accepted. We may correct or cancel a promotion that contains an obvious error before an order is accepted.
Discounted products remain subject to statutory rights and our ordinary Return and Refund Policy unless they are genuinely personalised or another legal exception applies.
20. Intellectual property
All intellectual-property rights in the Zima Store website and original content belong to us or are used under licence.
This includes, where applicable:
- The Zima Store name and logo;
- Original artwork and illustrations;
- Product designs;
- Website graphics;
- Photographs;
- Written copy;
- Branding;
- Page layout;
- Videos and promotional material.
You may access and use the website for personal, non-commercial shopping purposes.
You must not, without prior written permission:
- Copy or reproduce our artwork;
- Sell or distribute copies of our designs;
- Use our branding to suggest an association or endorsement;
- Remove copyright or ownership notices;
- Scrape or systematically extract website content;
- Use our designs to create competing merchandise;
- Upload our artwork to another print-on-demand service;
- Use our content to train or build a commercial image or content-generation system.
Purchasing a physical product does not transfer ownership of the intellectual-property rights in the design printed on it.
21. Customer-provided content
Where we permit you to submit text, images, reviews, photographs or other content, you confirm that:
- You own the content or have permission to use it;
- It does not infringe another person’s copyright, trade mark, privacy or other rights;
- It is not unlawful, threatening, discriminatory, defamatory or obscene;
- It does not contain malicious code;
- It does not impersonate another person.
For personalised orders, you grant us and our fulfilment providers a limited licence to use the submitted content only as reasonably necessary to process, manufacture, deliver and support your order.
For reviews or social-media content that you expressly permit us to repost, you grant us a non-exclusive licence to display that content for promotional purposes. We will not claim ownership of your original content.
22. Prohibited uses
You must not use our website:
- For unlawful, fraudulent or abusive purposes;
- To infringe intellectual-property rights;
- To distribute viruses or harmful code;
- To attempt unauthorised access to the website or another account;
- To interfere with website security or operation;
- To submit false payment or identity information;
- To make fraudulent chargebacks or refund claims;
- To harvest personal information about others;
- To conduct automated scraping without permission;
- To harass customers, staff or service providers.
We may suspend access, cancel an affected order or report suspected unlawful conduct where reasonably necessary.
23. Third-party services and links
Our website is hosted by Shopify and may use third-party services for payment processing, manufacturing, delivery, analytics, advertising and customer support.
Our website may also contain links to third-party websites or social-media platforms.
We are not responsible for the content, availability, security or privacy practices of independent third-party websites. You should review their terms and privacy notices before using them.
This section does not remove our responsibility for service providers acting on our behalf in fulfilling your order.
24. Privacy and cookies
Our collection and use of personal data are explained in our Privacy Policy.
Our website also uses cookies and similar technologies. Where required, optional analytics and advertising technologies will be used only in accordance with your consent choices.
You can manage optional cookies through the cookie banner or Cookie Preferences link on our website.
25. Website availability
We aim to keep the website accessible and functioning properly, but we do not guarantee uninterrupted availability.
We may temporarily suspend or restrict access for:

- Events outside our reasonable control.
We will try to minimise disruption where reasonably possible.
26. Website information and errors

We will not rely on this section to impose a materially worse product or higher price after a contract has been formed without your agreement.
27. Our responsibility to you
We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
A loss is foreseeable where it was obvious that it might happen or where both you and we knew it might happen when the contract was formed.
We do not exclude or restrict liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Breach of your statutory consumer rights;
- Any other liability that cannot legally be excluded.
If you purchase products as a consumer, we are not responsible for business-related losses, including lost profit, lost business, lost revenue or loss of a commercial opportunity.
Nothing in these Terms affects remedies available to you under consumer law.
28. Events outside our reasonable control
We are not responsible for delays or failure caused by events outside our reasonable control, such as:
- Natural disasters;
- Severe weather;
- War or civil unrest;
- Government restrictions;
- Transport disruption;
- Postal or courier disruption;
- Industrial action;
- Widespread internet or payment-network failures;
- Epidemics or public-health emergencies;
- Unexpected manufacturing disruption.
Where such an event affects your order, we will contact you where reasonably possible and take reasonable steps to minimise the effect.
If the delay becomes substantial, you may have the right to cancel the affected order and receive a refund.

If a court or relevant authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.
The affected provision will be treated as modified only to the minimum extent necessary to make it lawful and enforceable.
32. No waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
33. Third-party rights
These Terms are between you and Zima Store.
Except where the law provides otherwise, no other person has the right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
34. Governing law and courts
These Terms are governed by the laws of England and Wales.
If you live in England or Wales, disputes may be brought in the courts of England and Wales.
If you live in Scotland, you may bring proceedings in Scotland or England and Wales.
If you live in Northern Ireland, you may bring proceedings in Northern Ireland or England and Wales.
Nothing in this section prevents you from relying on mandatory consumer protections that apply in the country where you live.
